1. Information We Collect

The information VyNext collects depends on how you use the platform. School and staff information may include school contact information, branding, staff names, professional email addresses, roles, permissions, account information, event and venue information, and other information needed to operate the school’s VyNext environment.

Fan and purchaser information may include name, email address, account information, purchase history, tickets, season passes, order information, transaction identifiers, and information needed to deliver tickets, confirmations, receipts, refunds, or other transactional communications. Certain ticket purchases may be completed without creating a fan account.

VyNext may process ticket and admission information including event, ticket type, ticket status, unique ticket or QR credentials, redemption status, scan timestamps, refunds, voids, and related records.

When schools use concessions, merchandise, box office, or other commerce features, VyNext may process product, inventory, transaction, fulfillment, payment-method, refund, and staff activity information. For cash transactions, VyNext may record the transaction but does not receive or possess the physical cash collected by the school.

VyNext may also collect technical information reasonably necessary to operate and secure the platform, such as device, browser, session, authentication, security, error, and usage information. The specific production analytics and optional tracking technologies used by VyNext may change as the platform develops.

2. Payments

Electronic payments made through VyNext may be processed by Stripe or another disclosed payment processor. VyNext does not need to receive or store a purchaser’s complete payment-card number or card security code to provide its normal payment functionality.

VyNext may receive limited payment information from the processor, including transaction identifiers, amounts, payment status, payment-method type, refunds, disputes, chargebacks, and other information needed to operate, reconcile, support, and secure transactions.

Where a school uses its connected payment account, the school remains the seller or merchant for its school transactions unless expressly stated otherwise.

3. How We Use Information

VyNext may use information to provide and operate the platform; authenticate users; manage school and staff access; administer events, tickets, admissions, season passes, concessions, merchandise, and other enabled features; process and record transactions and refunds; provide communications and customer support; provide authorized reports and analytics; prevent fraud and unauthorized access; maintain security and audit records; troubleshoot and improve the platform; comply with legal obligations; and enforce applicable agreements and policies.

VyNext does not sell school-provided student personal information and does not use school-provided student information to build advertising profiles or deliver targeted advertising to students.

4. Information We Share

VyNext does not sell personal information to advertisers. Information relating to a school’s events, transactions, purchasers, tickets, admissions, passes, concessions, merchandise, or other school activity may be available to authorized personnel of that school according to their roles and permissions.

VyNext may share information with service providers that help operate the platform, including payment processing, application infrastructure, hosting, authentication, transactional email, security, error monitoring, analytics, and support providers. These providers may process information as necessary to perform their services and subject to applicable contractual and legal requirements.

VyNext may disclose information when reasonably necessary to comply with law or legal process, protect the rights or safety of VyNext, schools, users, or others, investigate fraud or security incidents, enforce agreements, or establish, exercise, or defend legal claims.

Information may also be transferred as part of a merger, acquisition, financing, restructuring, formation or transfer of the VyNext business to a legal entity, sale of assets, or similar business transaction, subject to applicable law.

5. Student and Child Information

VyNext is designed primarily for schools, school personnel, purchasers, parents, guardians, fans, and other authorized users. Some school-enabled features may involve limited information relating to students.

VyNext seeks to minimize student information and avoid receiving education records unless a feature genuinely requires them. Schools should not upload sensitive student information into features that are not designed to receive it.

Where a school provides education records or other protected student information to VyNext for an authorized school purpose, VyNext will process that information on the school’s behalf and subject to applicable contractual and legal requirements, including applicable FERPA requirements.

VyNext does not intend to require children under 13 to independently create general consumer accounts or provide personal information without an appropriate authorization or consent process where required by law. Student-facing features will be designed to collect only information reasonably necessary for their authorized purpose.

6. Communications

VyNext may send transactional or service-related communications such as account messages, security notices, ticket confirmations, receipts, refund confirmations, event notices, invitations, administrative notifications, and customer-support communications.

Where marketing communications are offered, legally required opt-out mechanisms will be provided. Opting out of marketing does not prevent necessary transactional, security, or account-related communications.

7. Cookies and Similar Technologies

VyNext currently uses cookies and similar browser storage for functions such as authentication, maintaining sessions, security, user-interface preferences, and Platform operation. For example, the application may store a cookie that remembers whether the navigation sidebar is open or closed.

VyNext also provides first-party operational and reporting analytics based on activity within the Platform. The current application review did not identify a separately integrated advertising tracker or third-party behavioral analytics tag such as Google Analytics, Meta Pixel, Mixpanel, Segment, or PostHog in the VyNext frontend.

Because currently identified cookies and browser storage are used for Platform functionality rather than behavioral advertising, VyNext does not presently display a generic advertising-cookie consent banner solely for those technologies. If VyNext later adds nonessential analytics, advertising, cross-site tracking, or other technologies that require additional notice, opt-out, or consent, VyNext will add the appropriate disclosure and controls before or when those technologies are enabled.

8. Data Security

VyNext uses administrative, technical, and organizational safeguards intended to protect information, including authentication, role-based access, school-level authorization, transaction protections, ticket-validation protections, audit capabilities, and other reasonable security measures appropriate to the platform.

No internet-connected system can guarantee absolute security. VyNext will address qualifying security incidents according to applicable law and contractual obligations.

9. Data Retention and Deletion

VyNext retains information for as long as reasonably necessary to provide the platform, maintain accounts, fulfill transactions, maintain ticket and admission history, maintain financial and accounting records, process refunds and chargebacks, prevent fraud, maintain security and audit records, comply with legal obligations, and resolve disputes.

When information is no longer reasonably necessary, VyNext may delete, anonymize, or de-identify it, subject to legal, accounting, backup, security, fraud-prevention, and dispute-resolution requirements.

Users may request closure of their account or deletion of eligible personal information. Some records cannot be immediately deleted, including records reasonably required for completed transactions, accounting, chargebacks, fraud prevention, security, school records, legal obligations, or enforcement of agreements. Where the applicable information is controlled by a school, VyNext may coordinate the request with that school.

10. School Data

Schools retain their rights in information and content they provide to VyNext. VyNext processes school-controlled information to provide the services requested by the school.

Additional protections may apply under the VyNext School Customer Agreement, School Data Protection Addendum, or other school-specific data terms. VyNext does not sell school-controlled student personal information or use it for behavioral advertising.

11. Privacy Rights

Depending on applicable law, individuals may have rights concerning their personal information, potentially including rights to request access, correction, deletion, or a copy of certain information. Not every privacy law or right applies to every individual or category of information.

VyNext will honor applicable privacy rights as required by law. Privacy requests may be submitted through the Contact Us page while VyNext establishes its dedicated privacy contact channel.

12. Artificial Intelligence

VyNext may develop features that use artificial intelligence or automated content-generation technology. Before a production AI feature processes school or user information, VyNext will evaluate the information involved, purpose, provider, retention practices, security, student-privacy implications, and any disclosures or controls required for that feature.

VyNext will not silently expand the use of protected student information for unrelated AI training or other unrelated commercial purposes.

13. Changes to This Policy

VyNext may update this Privacy Policy as the platform, law, or privacy practices change. When material changes are made, VyNext will provide notice where appropriate and update the revision date. Where required, VyNext may request renewed consent or acknowledgment.
